Establishing Written Agreements

Because of the industry's preference for flexible working arrangements and commission-based employment, the Real Estate Industry Award creates a legal requirement for each employee, and their employer, to have a written employment agreement.

For Sales and Property Management employees, there are only two circumstances where a written agreement is not required:

  • if an employee is to receive all Award entitlements; or
  • if an employee has no commission entitlement (see Please Note below).

However the Awards require that a written agreement be registered with the PSAQ if an employee:

  • is to receive reduced Award entitlements; or
  • has any form of commission entitlement.

In order to register a written agreement with the PSAQ, the following paperwork is required:

  • Schedule 1 to the relevant Award (either Property Sales or Property Management); plus
  • A written employment agreement; plus
  • An agreement registration fee (currently $99.00), which is shared equally between employee and employer.
