WRITTEN EMPLOYMENT AGREEMENTS A MUST FOR MOST!
The Real Estate Industry Award 2010 (the Award) requires that an employer paying Commission, Bonus or Incentive Payments to an employee must have a written agreement with that employee. This would apply to most salespeople and many property managers.
SECTION 15 requires that all employees receiving commission to have a written agreement with their employer stating how it is to be calculated.
SECTION 16 requires that any employee receiving commission only payments that exceed the minimum 35% of net office commission must have the calculation detailed in a written agreement with their employer.
